1. Definitions

1.1 “Client” means any individual or company booking a beauty service or training with Nili Academy.
1.2 “Service(s)” means any permanent make-up, microblading, lip blush, eyeliner, or beauty treatment performed by Nili Academy.
1.3 “Course(s)” means any in-person training, workshop, or professional education conducted by Nili Academy.
1.4 “Agreement” means these Terms & Conditions together with any confirmed booking, invoice, or related document.
1.5 “We,” “Us,” and “Our” refer to Nili Academy, its staff, trainers, and representatives.

2. Scope

2.1 These Terms apply to all bookings made for Services or Courses offered by Nili Academy.
2.2 By booking, the Client confirms full acceptance of these Terms and agrees to be legally bound by them.
2.3 No alteration or addition to these Terms shall be valid unless agreed in writing by Nili Academy.

3. Bookings & Confirmations

3.1 Bookings may be made online, by phone, or in person.
3.2 A booking is only confirmed once payment (or deposit) has been received and written confirmation issued by Nili Academy.
3.3 We reserve the right to decline any booking request at our discretion.

4. Client Responsibilities

4.1 Clients must provide accurate personal and medical information when booking a Service.
4.2 Clients agree to follow all pre-treatment and after-care instructions provided.
4.3 Clients must arrive on time; late arrival may shorten or forfeit the appointment or training without refund.
4.4 For Courses, participants must comply with safety and professional conduct standards at all times.

5. Our Responsibilities

5.1 We will deliver all Services and Courses with reasonable skill, care, and professionalism.
5.2 We will provide all essential materials, equipment, or kits as described for each Course.
5.3 We may change instructors, venues, or schedules where necessary, ensuring reasonable notice to Clients.

6. Fees & Payment

6.1 All prices are stated in Euros (€) and include VAT unless otherwise specified.
6.2 Accepted payment methods: cash or card at the studio or approved point of sale.
6.3 Full payment or deposit must be received before the start of any Service or Course.
6.4 Failure to complete payment by the due date may result in cancellation of the booking.
6.5 Any promotional offers or discounts must be confirmed in writing and may be withdrawn at any time.

7. Cancellations, Rescheduling & Refunds

Cancellations and refunds are governed by the Cancellation & Refund Policy below.
We reserve the right to postpone or cancel appointments or training due to illness, unforeseen events, or force majeure.
In such cases, the Client will be offered a new date or full refund (excluding non-recoverable costs).

8. Health, Safety & Medical Disclosure

8.1 Clients must disclose any health or skin conditions, medications, or allergies that could affect treatment.
8.2 Nili Academy reserves the right to refuse or postpone a treatment or training session if it is unsafe to proceed.
8.3 Results vary per individual; no specific outcome can be guaranteed.

9. Intellectual Property

9.1 All course materials, manuals, photos, logos, and trademarks remain the property of Nili Academy.
9.2 No materials may be copied, recorded, or distributed without prior written consent.
9.3 Clients may use the materials solely for personal learning and not for teaching or resale purposes.

10. Liability

10.1 Nili Academy shall not be liable for any indirect, incidental, or consequential loss arising from Services or Courses.
10.2 Our total liability is limited to the amount paid for the relevant Service or Course.
10.3 Nothing excludes liability for death or injury caused by our negligence where prohibited by law.

11. Privacy & Data Protection

11.1 We process personal data in accordance with GDPR and Dutch privacy laws.
11.2 Client data is collected for booking, payment, and communication purposes only.
11.3 Clients may opt out of marketing communications at any time by written request.

12. Dispute Resolution & Governing Law

12.1 These Terms are governed by the laws of the Netherlands.
12.2 Any disputes shall be subject to the jurisdiction of the competent courts in Den Haag (The Hague).
12.3 Both parties agree to attempt amicable resolution before formal proceedings.

13. General Provisions

13.1 If any part of these Terms is found invalid, the remaining provisions shall continue in effect.
13.2 No waiver of any breach shall be deemed a waiver of subsequent breaches.
13.3 These Terms constitute the entire agreement between Nili Academy and the Client.

Payment Policy

  1. Clients must pay in full or place a required deposit at the time of booking.

  2. Payments are accepted in cash or by card at Nili Academy’s premises.

  3. Balances for Courses must be settled before training commences.

  4. Refunds will be processed within 7 calendar days of approval via the original payment method.

  5. Failure to pay may result in suspension or cancellation of the Service or Course.

  6. Nili Academy reserves the right to change prices without notice, except for confirmed bookings.

Cancellation & Refund Policy

A. Beauty & Permanent Makeup Services

  1. More than 48 hours’ notice: Full refund or free reschedule.

  2. 24–48 hours’ notice: 50% of service fee retained as cancellation fee.

  3. Less than 24 hours / no-show: 100% of service fee charged, no refund.

  4. Rescheduling: Free if requested > 48 hours before appointment; otherwise subject to fee.

  5. Cancellation by Nili Academy: Clients may choose to reschedule or receive a full refund.

B. Training Courses & Workshops

  1. More than 14 days’ notice: Full refund minus any non-recoverable costs (e.g., materials).

  2. 7–14 days’ notice: 50% refund or credit toward a future course.

  3. Less than 7 days / no-show: No refund.

  4. Rescheduling: Permitted subject to availability and administrative fee.

  5. Course cancellation by Nili Academy: Client offered full refund or transfer to next available course.

  6. Refund timeline: Refunds processed within 7 calendar days after written confirmation.

Force Majeure

Neither party shall be liable for delay or failure to perform obligations due to events beyond reasonable control, including but not limited to illness, government restrictions, pandemics, or natural disasters.
In such circumstances, Nili Academy may postpone or cancel services and refund payments received, excluding non-recoverable costs.

Photography & Media

By attending a Course or receiving a Service, Clients consent to Nili Academy using non-identifiable photos or videos for educational or marketing purposes unless they opt out in writing before the appointment or training.
